Terms and conditions

These general terms and conditions of sale apply to the contractual relationship between SAS PRALUS, a company whose Head Office is located 34 rue Général Giraud 42300 ROANNE, and the client of the on-line store/boutique* of our web-site www.chocolats-pralus.com, a physical person who does not engage in trading operations. Once an order has been placed, the client agrees to accept all of the general conditions and terms of sale below. These terms will override any other terms written out in any other document unless a prior exception has been made and expressed in written form.
 
1. The products
PRALUS and company reserve their full right to add or withdraw products from the catalogue at all times and without notice.

 
2. Availability of the products
The client’s order will be filled according to the amounts in stock available from our production site.
 
3. Price – Payment of goods The prices advertised on our web-site www.chocolats-pralus.com and in the on-line store/boutique* are given in Euros.
Carriage is not included in the price indicated on the product description.
The total amount indicated in the summary of your order is the final price. This amount includes the price of all products ordered with details of each product and carriage. All the prices indicated are inclusive of tax. (All Taxes Included) including VAT. The full amount due must be paid upon ordering. No order will be processed until complete payment has been received.
 
4. Ordering
- An order is validated by our client and recorded by our web-site’s on-line store/boutique* at www.chocolats-pralus.com when the client clicks on the choice of payment method on the page "Summary of your order". This record implies that the client accepts the contents of the order and all of these General Terms and Conditions of Sale and will also stand as proof of the date the order was placed. PRALUS and Company will send confirmation that the order has been accepted to the E-mail address indicated by the client
- SAS PRALUS reserves full rights to refuse or cancel any new order placed by a client with whom any dispute has occurred. Once we have received acceptation of settlement from the bank card centre, orders placed via the Internet are prepared and dispatched the same day if they are placed before noon, or the following day if they are placed later than noon. Orders recorded on our web-site from after 12 a.m. on Friday until Monday (French time) will be dispatched for delivery from Tuesday afternoon (except for bank holidays).
- When placing an order the client takes entire responsibility for supplying us with the following information : Name and Given Name, address, E-mail address, phone number (optional)
- If any mistake is made in the client’s address, SAS PRALUS will in no case be held responsible if the goods cannot be delivered. In this should occur, SAS PRALUS will not reimburse the carriage to the client once the goods have been dispatched ; this also applies to orders cancelled by the customer once they have been dispatched.
- An invoice is sent to the customer by E-mail for each order as soon as the parcel has been dispatched from our warehouse.
- The data recorded on the information system at SAS PRALUS will be used as proof of all the transactions carried out between the clients and SAS PRALUS.
 
5. Delivery

Delivery rates
Delivery rates include packaging and carriage and will be partially born by the client. They will be invoiced in addition to the price of the goods ordered. The amount charged for delivery will depend on the goods ordered, the means of transport used and the weight and volume of the goods to be delivered.
 
Delivery time
Delivery time is as follows :
France, Corsica : 3 days by Colissimo (recorded delivery), except for weekends.
 
These deadlines are indicative. Damages will not be payable if for any reason the goods are delivered later. We will in no circumstances be held responsible for damage caused to products if the parcels are opened during delivery, nor if the recipient is away when the parcel is delivered. We must warn our customers in remote destinations (between 3 and 5 days delivery time) that despite the special packaging used during the hot season, hand-made chocolates travel better in the cooler seasons of the year. Delivery times can under no circumstances be guaranteed during the festive seasons such as Christmas, Easter, Saint Valentine’s Day or Mother’s Day, etc…. During these periods no credit notes will be issued for orders that are delivered late.
 
6. Revocation
The customer has a period of seven clear days from the receipt of goods to enforce his right to recant without having to justify why nor pay any penalties except, if applicable, the expenses incurred to return the goods. SAS PRALUS promises to exchange, issue a credit note or reimburse goods as long as they are returned intact and in their original packaging with no trace of use and with their original printable invoice. Any goods returned incomplete, damaged or soiled by the customer will not be taken back, exchanged or reimbursed. If SAS PRALUS should make a mistake in the contents of an order, the expenses incurred by returning the product that was not ordered will be reimbursed to the customer by SAS PRALUS

7. Replacement and Reimbursement
No return, reimbursement or replacement of goods will be accepted. No reservations on criteria concerning the taste, the freshness or the appearance of the goods will be accepted from the client. If goods cannot be delivered because of problems due to customs, strikes or damage resulting from any act of God, the forwarding agent will be held liable. The products will be replaced or reimbursed.
 
8. Liability
SAS PRALUS will be partly or totally relieved of liability if there is proof that the consumer or an unforeseen third party to the contract has partly or totally breached the contract or if an Act of God should occur..
SAS PRALUS cannot be held responsible for damage of any kind caused by the improper use of the goods delivered to the client. Whatever the case, SAS PRALUS’s liability will be limited to the amount of the order placed.
 
9. Legislation
These General Terms and Conditions of Sale obey French Law.
 
10. Litigation
SAS PRALUS and the Client will always seek an out of Court arrangement before resorting to court proceedings. If litigation is envisaged the Court in ROANNE will be competent.
 
11. Confidentiality of personal data
All the nominative information taken from out clients is necessary to process and dispatch orders and establish the corresponding invoices. If such information is not provided the order will be refused. To respect the legislation on « Information and Freedom » SAS PRALUS declares all the personal data taken to process an order to the French National Commission on Information and Liberties (CNIL).
According to Article 34 of the law of 6 January 1978, the client has the right to have access to, change, correct or delete his personal data. This right can be enforced by contacting SAS PRALUS:
